TERMS AND CONDITIONS:
A. Contest Details, Concept and Participation:

1. This activity will start on 9th October 2023 and end on 30th October 2023. No entry or registration will be entertained after the midnight of 30th October 2023.
2. This activity is open only to persons of age 18 years and above, as on 9th October 2023 Participation in this activity is purely voluntary. Participation in this activity implies acceptance of these terms and conditions.
3. This activity is valid for the residents of the state of Uttar Pradesh, Uttarakhand, Bihar and Jammu only.
4. The contest is not applicable in or for the residents of the state of Tamil Nadu. Any missed call or participation received from the residents of states other than those specified above will not be considered. Participation in this activity will be treated as void ab initio wherever such activities are specifically prohibited under local laws.
5. This pack is also available without this activity.
6. The eligible individuals who intend to participate in this activity should upload their photograph on www.joshilamoment.in The eligible participants can scan the QR code which will provide a link. The eligible participants can click the link to visit the website. The eligible participants shall enter the unique code on the website. The entries shall be judged on the basis of style and innovativeness.
7. All participants completing the activity will receive an assured reward of their selfie integrated with a background-filter of their choice, that can be downloaded.
8. Top 2 winning entries stand a chance to win Mega Prizes. The 1st prize& 2nd prize will be preselected bike gift voucher. Next 48 winning entries stand a chance to win Helmets Winners will be selected from the valid and eligible entries and will be informed call on the registered mobile number as per the process specified “Section F contacting winners”.
9. 33 winning entries each week for 3 weeks, stand a chance to win a Cashback Vouchers/UPI worth Rs. 300 each. Cashbacks will be credited by UPI Transfers/Vouchers. Weekly voucher winners will be informed within 14 days of uploading the photo, via SMS.
10. 9905 winners daily for 21 days will stand a chance to win cashback worth Rs.50 or Rs. 20 or Rs. 10 Cashbacks will be credited by UPI Transfers/Vouchers. Daily voucher winners will be informed by SMS, within 48 hours of uploading the photo.
11. KYC Details, address and id proof, to be presented by winner, for delivery of prize.
12. The participants must not submit unlawful, offensive, abusive, pornographic, harassing, blasphemous, defamatory, obscene, hateful, racially or ethically objectionable, or otherwise inappropriate material.
13. Prize(s) shall be given once original pack insert along with valid proof of identity, address and age have been provided by the winner.
14. There is no warranty or assurance as to the quality of prizes won. The prizes in our communication are meant for illustration purpose only, actual prizes may differ.
15. ITC limited (ITC) reserves the right to reject the claim if any of the terms or conditions are not met. ITC will not be liable in any manner for any claim arising out of or in respect of this activity.
16. ITC unilaterally reserves the right to change the terms and conditions of this activity including extending, withdrawing or discontinuing the same without notice or assigning any reason, at its sole discretion and without any liability.
17. Employees of ITC and their family members are not entitled to participate in this activity.
18. All disputes are subject to the exclusive jurisdiction of the courts at Kolkata.
19. A damaged or illegible packaging insert may be rejected.
20. The contest is not applicable in the state of Tamil Nadu. ITC Limited reserves the right to reject the claim if any of the terms or conditions are not met. ITC Limited will not be liable in any manner for any claim arising out of or in respect of this activity.
21. By participating in the activity, the Participants consent to collection, storing, processing and use of personal information and sensitive personal information of the Participants by ITC and its service providers.
22. This activity shall be governed by the privacy policy of ITC published here https://www.itcportal.com/about-itc/policies/privacy-policy.aspx
23. ITC is only responsible for providing the voucher. The voucher shall be governed by the terms and conditions mentioned on the voucher.
24. Each participant will be allowed only one valid entry.
B. Prize Details:

C. Steps to Register in the contest:

1. Give a missed call on 7406744466 to receive a chatbot link via SMS Scan the QR
2. Visit the chatbot and enter your name, age, pin-code, phone number and email ID. Choose your desired filter out of the 4 options. You will be routed to Facebook to click a picture using the selected option.
3. Enter the unique code and submit the picture on the chatbot (retain the pack insert & selfie to claim the reward if selected as a winner).
4. If you are a shortlisted winner for Cashback, you will be provided with a reward code and weblink to redeem the same.
5. If you are a shortlisted winner for Gold Coin, you will be contacted by the Partner Agency to complete KYC.

D. Winners Selection

1. Prizes will be given subject to the winner satisfying the verification process of ITC.
2. One participant can win upto a maximum of 3 prizes (i.e., 1 Cashback Voucher Prize, 1 Helmet, 1 Mega Prize) during the contest period from a mobile number, email address, house address, PAN Card/Aadhar Card/ Household.
• If a participant has won any cashback prize, he/she shall not be eligible to win any further cashback prize, however, he/she shall be eligible to win helmet or bike gift voucher prize.
• If a participant has won helmet prize, he/she shall not be eligible to win any further helmet prize, however, he/she shall be eligible to win cashback voucher or bike gift voucher prize.
• If a participant has won any Mega prize, he/she shall not be eligible to win any further Mega prize, however, he/she shall be eligible to win cashback voucher or bike gift voucher prize.
3. The Prize cannot be transferred, exchanged or redeemed for cash. In the event that the winner does not take the prize in the time and manner stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize. Prizes must be taken as offered and cannot be varied.
4. Any unused prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken in exchange for cash.
5. The image of the prize depicted on the press ads/posters/TVC's/pack shots etc. are for illustrative purposes only and the actual prize may vary from the depiction made.
6. ITC or its Agencies shall not be liable for any loss or damage of the prize due to Act of God, Governmental action and other Force Majeure circumstances and shall not be liable to pay any compensation whatsoever for such losses.
7. ITC LIMITED shall provide the prize on an "as-is basis" and without any warranty or guarantee concerning the quality, suitability or comfort, and ITC LIMITED and/or its associates, affiliates and/ or its management, directors, officers, agents, representatives shall not be responsible for or liable (including but not limited to the product and service liabilities) for deficiency and/ or defect of any product/service and/or the prize or for any kind of consequential damages/ loss, in any manner whatsoever. If any Participant has any grievance with respect to the prize, he/she may directly contact the manufacturer.
8. The winner generation for Prizes will be done on the basis of Valid Unique Number + Unique mobile number + Unique Email ID + Unique Address

E. Prizes:

a. Cashback Voucher Prize:
▪ During the Contest Period, 2,08,105 winners will be selected to win Cashback Vouchers for the contest period of 21 days.
b. Helmet Prize:
▪ During the Contest Period, 48 winners will be selected for Helmet for contest period of 21 days.
c. Bike Gift Voucher Prize:
▪ During the Contest Period, 2 winners will be selected for Bike gift voucher worth upto Rs. 2,00,000 for contest period of 21 days.

F. Contacting Winners:

a. For Cashback winners: Once the Winners are selected, the Partner Agency appointed by ITC shall contact the winner on their registered mobile number within 24 -48 business hours. The winner will receive their Cashback voucher along with a weblink to redeem the offer. Business Hours are from Monday to Friday, between 10:30 AM to 5:30 PM, except public holidays.
b. For Helmet / Bike gift voucher Prize Winners: Once the Winners are selected, the Partner Agency shall process the gift for the winner. In the event the shortlisted winner's number is busy, unreachable, or he/she does not attend the call, upto two (2) more attempts will be made to reach the Participant. If even on the third attempt, the Participant does not attend the call, or is unreachable, the Participant's participation in the contest comes to an end and the Participant's entry stands cancelled and Participant becomes ineligible to receive the prize.
c. In the event the shortlisted winner attends the call on either the second or third attempt, the procedure outlined in step (d) shall apply.
d. If any shortlisted winner remains unreachable on the third attempt or is not interested in continuing in the Contest or is otherwise ineligible to participate or is not able to submit the required documents within the stipulated time as mentioned by the agency, no winner is selected, no prize shall be declared in respect of the contest.
e. In case of a positive response from the shortlisted winner for Winners, each such shortlisted winner will be required to send the following documents and collateral:
▪ Copy of Address proof (Electricity bill or Mobile Bill) for all winners
▪ Copy of Aadhar Card & PAN Card for Mega Prize winners
▪ Copy of Driving License for Mega Prize (Bike gift voucher) Winner
▪ Self-Attested copy of No Dues Certificate for Mega Prize (Bike gift voucher) Winner
▪ This will be referred to as Participation Package for the winner. The completed Participation Package needs to be sent to agency within 48 hours of the call made by Agency to the selected winner.
▪ Upon receipt of the Participation Package, Partner Agency shall scrutinize all documents. If all the documents and the original promotional pack with winning code clearly mentioned, submitted are in order and valid then be treated as a Confirmed Winner.
▪ ITC Limited or it’s partner agency can ask for additional documents / information from the participant at any time.
▪ No prize will be awarded if the information presented by the Participant(s) at the time of entering the contest is not factually correct.
▪ The cost and expenses of postage shall be borne by the participant himself. ITC LIMITED or the Partner Agency shall not be responsible for any accident or mishap or loss of the Participation Package by the participant in transit.
▪ The responsibility of ensuring that the Participation Package reaches the address as directed Partner Agency lies solely with the participants.
▪ No justification/explanation for non-receipt of the Participation Package or any missing documents shall be accepted.
In the event of death of the Confirmed Winner, no claim from the nominee or his/her legal heirs of the Confirmed Winner shall be entertained for receiving the prize.

2. Intellectual Property:

a. All right, title and interest, including but not limited to the Intellectual Property Rights, in the promotional material(s) and in any and all responses received shall vest solely and exclusively with ITC LIMITED at all times. ITC LIMITED or any person or entity permitted in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and or payment to the Participant.
b. All material submitted in connection with the Contest (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to ITC LIMITED upon submission and become the property of ITC LIMITED exclusively. ITC LIMITED may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of ITC LIMITED

G. General Terms and Conditions:

1. This activity is open to persons of age 18 years and above, as on 01.10.2022. Participation in this activity is purely voluntary. Participation in this activity implies acceptance of these terms and conditions.
2. This activity is open in selected states of India only i.e. West Bengal, Nagaland, Assam, Bihar, Jharkhand, Punjab, Chandigarh, Haryana, Himachal Pradesh, Rajasthan, Gujarat, and Maharashtra.
3. Any entry received from states apart from the states mentioned in point 2 will not be considered. Participation in this activity will be treated as void wherever such activities are prohibited under local laws.
4. Pack without this offer is also available without this activity.
5. This activity will start on 09/10/2023 and will end on 30/10//2023. No entry will be entertained after 30/10/2023
6. The eligible participants who intend to participate in this activity should upload the photograph on (chatbot link). Intended participants can also give a missed call on 7406744466 to receive the link to (chatbot link) by SMS. The entries shall be judged based on innovativeness, originality and modernity.
7. The participant must not submit unlawful, offensive, inaccurate, misleading, abusive, pornographic, harassing, libellous, blasphemous, defamatory, obscene, hateful, racially or ethically objectionable, disparaging, or otherwise inappropriate material and agrees to obtain any consents, permission or licenses that may be legally required to submit any material or content and respect the privacy of others.
8. The winner should surrender the packaging insert in original at the time of receipt of the Gold Coin. Any damaged or illegible packaging insert will be rejected. Prize shall be given subject to winner showing a valid proof of identity, address and age. No additional claim will be entertained.
9. There is no warranty or assurance as to the quality of prize. The actual prize won may differ in size, shape or colour as compared to the ones depicted in communications.
10. Prize won is non-transferable and cannot be exchanged or redeemed for cash.
11. ITC Limited (ITC) reserves the right to reject the claim if any of the terms or conditions are not met. ITC will not be liable in any manner for any claim arising out of or in respect of this activity.
12. ITC reserves the right to change the terms and conditions of this activity including extending, withdrawing, or discontinuing the same without notice or assigning any reason, at its sole discretion and without any liability.

H. Bike Gift Voucher Terms & Conditions
a. “Bike gift voucher” shall mean and imply a base model of preselected bike of worth upto Rs 200000, at the ex-showroom Price.
b. “Price” shall mean the ex-showroom basic price of the Bike and not the “on-road” price and specifically excludes all taxes, registration costs, insurance, levies, etc. (as may be applicable).
c. The bike voucher holder to bear the cost of Road Tax, Insurance, Registration, and any other incidental costs that occur.
d. All forms of taxes, including gift tax, income tax road tax, levies or other taxes, registration charges, insurance, etc. will be borne by the winner.
e. The prizes are personal to the winners and are not transferrable and cannot be sold under any circumstances. Prizes cannot be exchanged for cash or kind. No request for a change in make, model, colour, and specifications etc of the car will be entertained.
f. All the participants shall be required to ensure that the mobile number(s), e-mail address and/or other details provided by them via the website or otherwise are true, accurate and in use. Any liability, consequence or claim arising on account of any incorrect or outdated information provided by the participants agency shall solely be borne by the affected/concerned participants.
g. ITC LIMITED or it’s partner agency shall at no time be required to verify the accuracy and/or correctness of the information so provided by the participants. Further, you are responsible for maintaining the confidentiality of your mobile phones, e-mail accounts and passwords.
h. ITC LIMITED or it’s partner agency accepts no responsibility for any tax implications that may arise from the prize winnings. Tax is to be borne by the winner. Winners will have to bear incidental costs if any, that may arise for redemption of the Prizes.
i. The delivery time will vary depending on the availability of the Bike. On receipt of complete Winners information and completion of all formalities, the approximate delivery time will be communicated to the confirmed winners. Goods once delivered cannot be replaced under any circumstances.
j. Premier Sales Promotions Pvt. Ltd. will offer product warranty in case it is offered by manufacturer/distributor and all claims towards warranty need to be taken up with the manufacturer/distributor directly.
k. In case the Bike is not available in the winner city, Premier Sales Promotions Pvt. Ltd. will arrange the availability of the in the nearest city wherever the bike dealership is available. All costs associated with traveling/accommodation or any other cost which might incur will be borne by the winner.
l. There is no cash alternative for the Prize and the same cannot be exchanged for cash at any point nor transferred to someone else.
m. ITC LIMITED reserves the right to substitute the Prize offered at any point of time. Such rewards will be of equal or greater value.
n. All warranties of any kind whatsoever, whether expressed or implied, are hereby expressly disclaimed by, ITC LIMITED but not limited to, meeting of the participants‟ requirements or aspirations, timeliness, security, un-interestedness, error-free, the results or reliability of the promotion, or the delivery, quality, quantity, merchantability, fitness for use or non-infringement in respect of any goods, services, emoluments, benefits or awards acquired or obtained through the promotion.
o. All the costs and expenses for collecting the prize will be borne solely by the winner and ITC LIMITED or it’s partner agency shall not entertain any claim, whatsoever. The winner is solely responsible for any other expenses related to the acceptance and use of the offer.

J. Cashback Terms & Conditions
a. This offer entitles the end user cashback on their Online Wallet or Bank Account Or UPI. The customer will be responsible for their choice of the cashback transfer method. The denomination of the cashback will be mentioned on the voucher/scratch card.
b. Any consumer purchasing a promotional product shall be eligible to receive a Voucher inside the pack. The customer shall receive a cashback of an amount equivalent to the value as mentioned in the Voucher (“Cashback/Voucher Amount”).
c. By redeeming the Offer provided on the same, a participant agrees to be bound by the terms and conditions below (“Conditions”).
d. These Conditions apply to every person ("Participant”) redeeming the offer given by Premier Sales Promotions Pvt Ltd, No claim shall lie for any redemption requests made after the expiry of the Offer Period.
e. If you are not a wallet partner registered customer, you will be required to register on the wallet partner website or Mobile App to receive your wallet cashback.
f. The customer will be responsible for entering details such as UPI ID, Account No, Online Wallet Mob Nos, etc. Premier Sales Promotions Pvt Ltd. will not be responsible for any incorrect entries or details on the promotion website. No change in details will be entertained once you have submitted the booking.
g. All Participants agree that wallet partner offering discount vouchers may at any time stipulate additional terms and conditions for redemption of the discount vouchers and such terms and conditions shall be binding on the Participants and shall apply to every redemption of recharge/discount voucher by the Participants.
h. The Wallet Partner holds the right to refuse transactions deemed fraudulent as per their policies.
i. In the event of any fraud detection, the wallet partner reserves the right to modify/change, discontinue, terminate, withdraw the Offer at any time during the Offer Period.
j. In no event shall Premiere Sales Promotions Pvt Ltd or its partner agency be held liable for any issues relating to the redemption of the voucher including redemption request not being honored by the wallet partner.
k. In no event shall the maximum liability exceed the value of the voucher as the case may be.
l. Any disputes or differences in connection with the offer shall be governed by laws of India and shall be subject to the exclusive jurisdiction of the Courts at Bengaluru.
m. The wallet partner reserves the right to restrict cashback for any account with suspicious behavior or invalid details/credentials. The wallet partner has the right to ask for documents to prove the customer/user's identity.
n. This offer is subject to promotional availability and government regulations.
